Resumo: O foco central deste trabalho gira em torno do conflito entre os instrumentos de promoção cultural adotados pelos diversos países e os princípios das regras de comércio internacional. O tema da diversidade cultural é objeto do sétimo instrumento normativo da UNESCO no campo da cultura. A trajetória de aprovação da Convenção sobre a Proteção e Promoção da Diversidade das Expressões Culturais, ocorrida em 2005, e sua ratificação por um número expressivo de países num curto período, traduzem o sentido de urgência na busca de alternativas para a questão da regulação do mercado de bens e serviços culturais.

Abstract: The main focus of this work is the conflict between instruments for cultural advocacy adopted by various countries and principles of international market rules. The cultural diversity issue is the object of the seventh UNESCO normative instrument in the field of culture. The approval process of the Convention on the Protection and Promotion of the Diversity of Cultural Expressions in 2005, and its ratification by an expressive number of countries in a short period of time shows the urgent need for searching alternatives for the regulation of the cultural goods and services market.
